A rede social Facebook poderá ter que suspender o acesso dos usuários em todo o País por 24 horas por descumprimento de uma liminar.
No final da tarde desta sexta, o Facebook apresentou ao juiz da 13ª Zona Eleitoral de Florianópolis, Luiz Felipe Siegert Schuch, autor da decisão, um pedido de reconsideração. O juiz ainda analisa o caso, que só deve ser decidido na próxima segunda-feira (13).
Se a decisão do juiz for mantida, o Facebook deverá interromper o acesso à rede social e apresentar a informação de que o site está fora do ar por descumprir a legislação eleitoral. Se essa determinação não for atendida, a empresa terá que pagar multa diária de R$ 50 mil e o prazo de suspensão do Facebook no País será duplicado.
De acordo com a decisão, o Facebook descumpriu uma liminar anterior que determinou que fosse retirada do ar a página "Reage Praia Mole". A suspensão foi solicitada pelo vereador Dalmo Deusdedit Menezes (PP), de Florianópolis, que concorre à reeleição. O parlamentar argumentou que houve veiculação de "material depreciativo" contra ele, feita de maneira anônima por um usuário. O juiz eleitoral também determinou a identificação das pessoas que criaram a página no Facebook.
Segundo o TRE-SC, o Facebook poderá recorrer ao tribunal regional ou ainda ao Tribunal Superior Eleitoral (TSE). A assessoria de imprensa do Facebook no Brasil informou que ainda aguarda um posicionamento oficial da sede, na Califórnia (Estados Unidos), para se manifestar.
