Samsung suffered another defeat in U.S. courts on the evening of Tuesday, and could not reverse the decision prohibiting the sale of the Galaxy Nexus smartphone in the country. South Korea had appealed the ban on Monday, trying to release the sale of the unit while the action on the Nexus broke or not Apple patents is discussed.
Judge Lucy Koh, who last week had prohibited sales after the action raised by Apple, said that there was sufficient evidence to sustain the preliminary injunction from Samsung. At CNET, a Samsung spokesman said he was disappointed with the decision.
"We believe today's decision will ultimately reduce the availability of high quality products to consumers in the United States. Meanwhile, we are also working closely with Google to resolve this issue, since the patent in question refers the unified search function of Google, "said the spokesman.
The Galaxy Nexus was announced by Google and Samsung in October last year, and was the first device to receive version 4.0 of Android, called Ice Cream Sandwich.
Beyond the Galaxy Nexus, Samsung is prohibited from marketing the tablet Galaxy Tab 10.1 in the United States. The California court rejected on Monday another feature of South Korea, which demanded that the sales were to resume, claiming that the product design copies the iPad from Apple.
Apple and Samsung, the two biggest consumer electronics companies in the world are waging a war in the courts of several countries, accusing each other of patent infringement as they battle for supremacy in the mobile market.
